The appeal of a man convicted of sexual assault in Whitehorse has been rejected by the Yukon Court of Appeal. Rudra Amin, currently residing in Calgary, was convicted in 2023 for assaulting three women between 2017 and 2018. Following a jury trial, he was found guilty on four counts of sexual assault. Amin promptly appealed his sentence and was subsequently released on bail.
In his appeal, Amin sought a reduction of two months from his slightly over two-year sentence to qualify for a conditional sentence order to avoid immigration repercussions. However, Justice Susan Griffin, in her ruling on Aug. 6, dismissed the appeal. She refuted Amin’s argument that the sentencing judge had erred and deemed his request for a conditional sentence unsuitable.
Griffin emphasized that Amin’s plea to shorten his sentence lacked merit unless he could demonstrate a fundamental error impacting the sentence. She stated, “This is simply tinkering and not this court’s proper role.” Consequently, Amin will serve his original sentence of just over two years.
